Personal data administrator

 

SMK Tuning Limited (further on referred as „Seller) is the administrator of personal data of Buyers participating in transactions with Seller.

All personal data is processed according to Data Protection Act 2018 (the ‘DPA’ or the ‘Act’) as well as Privacy and Electronic Communications Regulations (the ‘PECR’).

The Seller assures the Buyer the execution of rights arising from aforementioned act and current legislation.

 

How and why do we collect your data and who do we share it with?

 

The information we process about you include the information you have provided us with, the information we gather from third party service providers and databases and information coming form monitoring how you use our website or our services.

Your personal information is processed solely for the purpose of the concluding the transaction and  fulfilling your order and keeping proper records of this transaction.

With your prior consent, your data may also be processed for other purposes clearly stated in the consent.  Your personal information will be passed to third-party companies (such as subcontractors) and named delivery company for the purpose of delivering the ordered goods. The data will be used only for the purpose of order completion.

Our websites are hosted in outside the UK. We may also use outsourced services in countries outside the UK from time to time in other aspects of our business.

 

Payment information is never taken by us or transferred to us either through our website or otherwise. Our employees and contractors never have access to it.

At the point of payment, you are transferred to a secure page on the website of PayPal some other reputable payment service provider. That page may be branded to look like a page on our website, but it is not controlled by us.

 

What information do we collect about you?

The information we collect about you include but may not be limited to: personal identification such as your names, your title, your company name, contact information, such as your email address, your telephone number and your postal addresses for billing, delivery and communication, business information, including your business trading name and address, your company number (if incorporated), and your VAT number (if registered), account information, including your username and password , records of communication between us including messages sent through our website, email messages and telephone conversations, marketing preferences that tell us what types of marketing you would like to receive, technical information about the hardware and the software you use to access our website and use our services, including your Internet Protocol (IP) address, your browser type and version and your device’s operating system usage information, including the frequency you use our services, the pages of our website that you visit, whether you receive messages from us and whether you reply to those messages

transaction information that includes the details of the products services you have bought from us and payments made to us for those services

 

You have the right to access and rectify your personal information we store

 

As a Buyer, you have the right to access the personal information we store about you and rectify them. Each person has the right to control the processing of the information that concerns them. In order to execute this right, please contact us either via email or telephone (information provided in contact section).

 

Supplying your personal information is voluntary

 

Supplying your personal information is voluntary,  however we may ask you for some personal information that is crucial to complete transaction. You may refuse to give us the information but this will result in you not being able to participate in the transation and conclude a purchase agreement.

 

  

COMPLAINTS POLICY

 

We respect your right to file a complaint regarding the goods you purchase from us. Below you will find detailed information on our responsibility for faulty items and your rights connected to statutory warranty claims.

 

Basis and extent of the Seller's liability with respect to the buyer if the Product sold has a physical or legal defect (warranty) are defined by generally applicable laws, particularly in the Sale of Goods Act.

 

We are obliged to provide you with the goods free of defects. We take responsibility for any physical defect existing at the time of tranfer of the goods to you as well as the ones that become apparent within the reasonable period of time after the sale is made.

The complaint should be submitted via email to: office@smk-tuning.com . We recommend to provide the following description of the complaint: the statement of the subject of the complaint, in particular the type of the date of occurance of the defect, the details of your car model if the goods have been advertised as dedicated to particular car model and the pictures illustrating the subject of complaint.

We will reply to your complaint immediately but not later than 14 days after it was filed and offer appropriate solution.

  

 

RETURN POLICY

 

 You have the right to withdraw from your purchase without giving the reason. The time for cancellation of your order is 14 days from when either to you ar a third party named by you has taken the possession of goods. You will not be charged any addidtional fees except the ones mentioned below. In order to meet the deadline of 14 days it is enough to inform the Seller of your decision to withdraw from the purchase before the time expires. Your decision to withdraw from the purchase should be delivered in writing to email address: office@smk-tuning.com

Withdrawal and repayment

After your notice of taking advantage of your right to withdraw from the purchase you have 14 days to return the goods to us. In order to meet the deadline it is sufficient to send the item before the time expires to the following address:

The item should be returned in resaleble condition. The item should be sent back in original or similar to original packaging. Please send the item back in the same form you received it, i.e. if the boot liner was received rolled up please send it back also rolled up.

If you withdraw from the purchase we will return to  you all the payments we have received from you including the original shipping charge  immediately, but not later than 14 days after we receive your withdrawal notice. For the repayment we will use the same method as the one used in the original transations. We may withhold the repayment until we have received the goods back or until you provide the proof that the goods have been delivered, whichever is earlier.

 

Possible withdrawal fees

You will bear immediate costs of returning the goods.

You may also be charged and have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functioning of the goods.
